1. About TowMetrics

TowMetrics is a mobile towing weight measurement service based in the Albury-Wodonga region of Victoria, Australia. We provide on-site vehicle and caravan weighing services using calibrated equipment, producing weight reports to help customers understand whether their towing setup falls within their vehicle's manufacturer-specified weight limits and Australian towing regulations.

In these Terms, "we", "us", and "our" refer to TowMetrics. "You" and "your" refer to the customer or website user.

2. Nature of Our Service

It is important that you understand exactly what TowMetrics provides and what it does not:

What we do

• Measure the actual weights of your tow vehicle and caravan/trailer using calibrated weighing equipment at the time of service
• Compare those measurements against your vehicle's manufacturer-specified ratings (GVM, GCM, ATM, GTM, and tow ball download)
• Provide a written weight report summarising the results

What we do not do

• Issue roadworthy approvals or any form of government-recognised documentation
• Provide legal advice, engineering advice, or mechanical inspections
• Guarantee that your vehicle will remain within its rated limits after the service: load, fuel, passengers, and conditions change
• Inspect, assess, or approve tow hitches, safety chains, brake controllers, or other towing equipment

3. Bookings

Bookings can be made via our website, phone, or email. A booking is confirmed once you receive written or verbal confirmation from TowMetrics.

• You must ensure your vehicle and caravan/trailer are loaded as they would be for a typical trip at the time of service. This gives you the most useful and accurate result
• You are responsible for ensuring the vehicle and caravan are accessible and ready at the agreed time and location
• TowMetrics reserves the right to refuse or reschedule a service if conditions or equipment are unsuitable for safe measurement

4. Cancellations & Rescheduling

• Cancellations made with more than 24 hours notice will incur no charge
• Cancellations made with less than 24 hours notice may incur a call-out or administration fee
• If TowMetrics needs to cancel or reschedule due to equipment issues, illness, or circumstances beyond our control, we will contact you as soon as possible and offer an alternative time at no additional cost

5. Payment

• Payment is due at the time of service unless otherwise agreed in writing
• Accepted payment methods will be confirmed at the time of booking
• All prices are in Australian dollars (AUD) and include GST where applicable
• TowMetrics reserves the right to withhold the delivery of a report until payment has been received

6. Customer Responsibilities

You agree that:

• All information you provide about your vehicle, caravan, and towing setup is accurate and complete to the best of your knowledge
• You are the owner of the vehicle and caravan, or have authority from the owner to engage our services
• You will not use our reports in a misleading or fraudulent way
• You understand that our report reflects a measurement taken at a single point in time and that staying within your rated limits is your responsibility

7. Limitation of Liability

To the maximum extent permitted by Australian consumer law:

• TowMetrics is not liable for any fines, penalties, accidents, damage, injury, or legal consequences arising from your towing setup before, during, or after our service
• TowMetrics is not liable for losses arising from inaccurate information provided by you, including incorrect vehicle specifications or ratings
• TowMetrics is not liable for any indirect, consequential, or special loss or damage of any kind
• Our total liability to you for any claim arising from our services is limited to the amount you paid for the service in question

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL), including consumer guarantees that cannot be excluded by law.

8. Accuracy of Measurements

TowMetrics uses calibrated weighing equipment and follows consistent measurement procedures. However:

• Weights can vary depending on surface level, tyre pressure, fuel load, passenger weight, and cargo distribution
• Results reflect conditions at the exact time of measurement
• Minor variations between our measurements and those obtained by other means (e.g. public weighbridges) are normal and do not constitute an error in our service

9. Intellectual Property

All weight reports produced by TowMetrics are provided for your personal use only. You must not:

• Reproduce, sell, or distribute reports for commercial purposes
• Alter or misrepresent the contents of a report
• Use TowMetrics branding, logos, or report formats without our written permission

10. Website Use

By using our website at www.towmetrics.com.au, you agree to use it only for lawful purposes. You must not:

• Attempt to gain unauthorised access to any part of our website or systems
• Use automated tools to scrape, copy, or harvest content from our website
• Transmit any harmful, offensive, or disruptive content through our website or contact channels

12. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
